Changes from the New Year to the rules for dismissal.
Now there have been changes to the Working Environment Act, which came into force on 1 January 2024.
Maren Moe is a law student and works part-time at NITO, and has written her master's thesis based on this very change. She explains that the purpose of the rule is to strengthen the position of employees in groups and that there are three important changes in particular that employees should be aware of. These changes are particularly relevant in the case of downsizing in groups.
Plikten til å tilby annet passende arbeid til arbeidstaker som står i fare for oppsigelse grunnet virksomhetens forhold utvides til konsernforhold. Gjennom lovendringen har arbeidsgiver fått en plikt til å undersøke om det finnes annet passende arbeid å tilby arbeidstakeren i de andre virksomhetene i konsernet før eventuell oppsigelse gis. Fram til i dag har arbeidsgiver kun hatt plikt til å tilby annet passende arbeid i egen virksomhet.
Dersom man er sagt opp på grunn av virksomhetens forhold, f.eks. gjennom en nedbemanning, vil arbeidstakeren ha fortrinnsrett til ny ansettelse både i egen virksomhet og de andre virksomhetene i konsernet. Fortrinnsrett til ny ansettelse i andre virksomheter enn der man opprinnelig var ansatt er nytt for i år.
Det skal etableres ordninger for informasjon og drøftinger mellom arbeidstakerne og virksomhetene i konsernet. Dersom det skal gjennomføres endringer som kan få vesentlig betydning for sysselsettingen i flere av virksomhetene i konsernet skal dette informeres om og drøftes så tidlig som mulig, heriblant med tillitsvalgte. Dette kan f.eks. være omorganiseringer eller andre tiltak som kan føre til nedbemanning.
The rules apply to more forms of amalgamation of companies than the term group is traditionally understood in company law. A separate group definition has been included in the Working Environment Act that regulates this.
The employee side in particular has been calling for an expansion of employer responsibility in groups for a long time.
"There is a constant development in the formation of groups, and about half of all employees today work in a company that is part of a group. It is seen that decisions are made at group level that have an impact on the employees' job protection in the subsidiaries. It is therefore important that responsibility is also attached to this decision-making competence. It will be exciting to see what impact the new rules will have in practice," Moe concludes.
