Says no to new main agreement with KS

KS did not want to keep the point in the Basic Agreement between Akademikerne and KS, which allows for local pilot schemes. This scheme makes it possible for the municipalities to solve their special challenges through agreements between local parties.
"For the academics and NITO, it has been important to retain the opportunity for the local parties to enter into local pilot schemes," says Gro Gaarder, head of the collective bargaining committee for NITO municipality.
In principle, it is not allowed to enter into local special agreements that violate centrally entered provisions in central collective agreements, but the pilot scheme makes it legal.
Permanent pilot schemes
- In practice, it has been shown that the provision is used in such a way that pilot schemes become permanent, and perhaps at times not entirely legal according to the Working Environment Act. We believe that better guidance in the pilot scheme could have tightened the broad practice. The pilot scheme is a good tool for solving specific local challenges and achieving local adaptation in a difficult time in the municipal sector," says Gaarder.
NITO and Akademikerne therefore do not have a new main agreement with KS. The main agreement will thus become part of the spring wage settlement.
Until this settlement is completed, the main agreement, which expires on 31 December 2025, will live on the after-effect until the spring settlement is concluded.
This is the paragraph that has now been deleted from the new main agreement that KS has entered into with LO, Unio and YS:
§ 4 – 6 Local pilot schemes
Negotiations take place between the individual municipality/county municipality/company and the individual trade union or bargaining association's local level. Pilot schemes may be entered into locally that deviate from the central collective agreement where all the parties concerned agree on this. Such pilot schemes are entered into in the form of a local special agreement. The special agreement lapses at the end of the special agreement period, unless the parties agree on a new agreement before the expiry date. The central parties shall be informed of the local pilot schemes that have been entered into.
