Privat sektor - bestemmelser om fri for å delta på tillitsvalgtkurs

Hovedavtalene NITO har med NHO og Virke gir deg rett til tjenestefri for å delta på tillitsvalgtsopplæring. Mange arbeidsgivere gir fri med lønn, men dette bør du avklare med arbeidsgiver så tidlig som mulig. Dersom arbeidsgiver trekker deg i lønn for tiden du deltar på tillitsvalgtopplæring, kan du få dekket tapt arbeidsfortjeneste av NITO.

Direkteavtale
Direkteavtaler er avtaler mellom NITO og en bedrift som ikke er medlem av en arbeidsgiverforening.

Ordlyden i disse avtalene vil dermed kunne variere noe, men NITOs mal for slike avtaler har samme ordlyd som i NHO-avtalen når det gjelder fri for tillitsvalgte - se over.

Ingen tariffavtale?
Selv om din bedrift ikke har noen tariffavtale, kan du likevel søke om fri for å delta på kurs. Mange arbeidsgivere ser positivt på dette og gir fri selv om det ikke er noe du har krav på. 

Staten - bestemmelser om fri for å delta på tillitsvalgtkurs

Hovedavtalen i staten gir deg i utgangspunktet rett til fri med lønn for å delta på tillitsvalgtopplæring. Avklar med arbeidsgiver så tidlig som mulig.

Kommunal sektor - bestemmelser om fri for å delta på tillitsvalgtkurs

Hovedavtalen med KS gir deg rett til fri for å delta på opplæring som har betydning for din funksjon som tillitsvalgt. 

Hovedavtalen med KS gjelder for NITOs medlemmer i

  • kommuner, fylkeskommuner og kommunale eller interkommunale selskaper 
  • energibedrifter tilknyttet Samfunnsbedriftene
  • selvstendige bedrifter i kommunal sektor tilknyttet Samfunnsbedriftene

Rett til fri i Oslo kommune
De tillitsvalgtes og arbeidsgivers gjensidige rettigheter og plikter følger av Hovedavtalen og andre tariffavtaler inngått mellom Oslo kommune og arbeidstakerorganisasjonene kap. 3.

Se særlig §16 som regulerer de tillitsvalgtes arbeidsvilkår, herunder rett til permisjon med lønn.

Spekter - bestemmelser om fri for å delta på tillitsvalgtkurs

Hovedavtalen mellom SAN og Spekter gir deg rett til fri med lønn inntil tolv dager per år for å delta på tillitsvalgtopplæring. Dette må du avklare med arbeidsgiver så tidlig som mulig.
